HOTEL TERMS AND CONDITIONS OF SERVICE

Effective Date: June 21st 2025


These Terms and Conditions ("Terms") govern the contractual relationship between the Guest ("You" or "Guest") and Stay549 ("Hotel," "We," or "Us"). By making a reservation, checking in, or utilizing our services, You agree to be legally bound by these Terms.


1. PRICES AND TAXES


1.1 All rates are quoted in Canadian Dollars and are subject to availability at the time of booking. Rates include applicable taxes unless otherwise expressly stated.


1.2 We reserve the right to adjust prices and taxes at any time without prior notice, except for confirmed reservations, which shall be honored unless modified by the Guest.


1.3 Any additional charges (including but not limited to room service, mini-bar usage, telephone calls, and laundry services) are excluded from the room rate and will be billed separately.


1.4 Local taxes, city taxes, or other mandatory levies imposed by government authorities shall be charged in addition to the room rate, where applicable.


2. PAYMENT TERMS; CHECK-IN AND CHECK-OUT


2.1 Payment in full is required at the time of booking unless otherwise specified in Your reservation confirmation. The Hotel accepts major credit cards. Personal checks, pre-paid cards, cash and debit-cards are not accepted.


2.2 A security deposit and pre-authorization of Your credit or debit card may be required at check-in. The pre-authorization is a temporary hold of funds for potential incidental charges and will be released after check-out, subject to any deductions for damages or outstanding charges.


2.3 Check-in is available from 2PM Local Time and check-out must be completed by 10AM Local Time. Late check-out is subject to availability and additional fees, which the Guest agrees to pay.


2.4 The Hotel reserves the right to cancel the booking or refuse check-in if full payment is not made or if fraudulent activity is suspected.


2.5 All bookings are charged a 50% non-refundable fee for the total cost of the booking. Cancellations will forfeit the 50% deposit up on check-in. No show subject to full price of booking.

2.6 I understand that should I wish to extend or add rooms, they will be added at current daily rates direct with Stay549 and not that of your initial reservation.


2.7 You agree to pay all charges incurred in addition to the posted total above by me during my stay in the hotel including but not limited to room charges, changes to the reservation such as extending days or adding rooms.


3. NON-SMOKING POLICY


3.1 The Hotel enforces a strict non-smoking policy throughout all rooms and common areas, including but not limited to the lobby, hallways, and balconies.


3.2 Smoking, including the use of e-cigarettes or vaporizers, smudging, marijuana or similar devices is strictly prohibited. Violation of this policy will result in a cleaning fee of 500.00 and may result in immediate eviction without refund.


3.3 Designated smoking areas may be provided outside the Hotel premises. Please inquire at the front desk for the designated location.


4. TRAVELING WITH MINORS


4.1 Guests under the age of 18 are not permitted, this property is for guests ages 18 and up. Proof of age may be requested.


5. ACCESSIBILITY AND SPECIAL NEEDS


5.1 Accessibility Limitations: Please be advised that Stay549 features steep staircases, uneven terrain, and lacks elevator access. Due to the physical layout and inherent characteristics of the property, we are unable to provide accessibility accommodations for Guests with mobility impairments, including but not limited to those who require wheelchair access or have difficulty navigating stairs.


5.2 Non-Recommended for Guests with Mobility Issues: We regret that Stay549 is not suitable for individuals with limited mobility, and we strongly advise such Guests to consider alternative accommodations that can better meet their needs.


5.3 No Liability for Accessibility Issues: By booking a stay at Stay549, Guests acknowledge that they have been informed of the property’s accessibility limitations. The Hotel disclaims any liability for injuries, inconvenience, or dissatisfaction related to accessibility constraints or the inability of Guests to safely navigate the property.


6. PARKING


6.1 Parking facilities are provided for Guests subject to availability. Parking is provided free of charge.


6.2 The Hotel disclaims any liability for loss, theft, or damage to vehicles or personal belongings left within vehicles parked on Hotel property.


6.3 Guests must adhere to all posted parking regulations and restrictions. Unauthorized vehicles may be towed at the owner's expense.


7. MAIL AND USE OF ADDRESS


7.1 No Mail Forwarding Services: The Hotel does not provide mail forwarding services. Guests acknowledge and agree that the Hotel shall not be responsible for accepting, holding, or forwarding any mail or packages addressed to them before, during, or after their stay, unless explicit permission is granted by Hotel management.


7.2 Return of Unapproved Mail or Packages: Any mail or packages received without prior authorization from Hotel management will be returned to the sender whenever possible. The Hotel shall not be held liable for any loss, damage, or delay of mail or packages addressed to Guests.


7.3 Guest Responsibility for Mail Arrangements: Guests are solely responsible for arranging their own mail forwarding services and ensuring that their mail and packages are properly addressed to their intended destination. The Hotel disclaims any responsibility for lost or misdirected mail due to improper addressing or failure to arrange forwarding services.


7.4 Disposition of Misdelivered Mail or Packages: In the event that a package or mail item is mistakenly delivered to the Hotel, the Hotel reserves the right to:


• Dispose of the package without notification if it cannot be returned to the sender.

• Contact the Guest and assess a handling fee for returning the package. Additional storage fees may apply if the package is held at the Guest's request.

• Charge the Guest for any shipping or handling costs incurred. Payment for such costs must be received within 60 days of notification; otherwise, the item will be considered abandoned and disposed of at the Hotel’s discretion.


7.5 Prohibited Use of Hotel Address: The use of the Hotel's address for purposes unrelated to the Guest’s stay is strictly prohibited. This includes, but is not limited to:


• Setting up banking or credit accounts.

• Establishing residency or applying for official identification, such as medical cards or driver’s licenses.

• Engaging in any activity that is unlawful or unrelated to the Guest's temporary accommodation at the Hotel.


7.6 Legal Action and Notification of Violations: The Hotel reserves the right to take legal action against any Guest who uses the Hotel's address for improper purposes. This may include notifying relevant authorities or parties affected by the unauthorized use of the address.


7.7 Limitation of Liability: The Hotel disclaims any liability for lost, delayed, or damaged mail or packages, regardless of the circumstances. Guests acknowledge and accept full responsibility for any risks associated with the handling of their mail and packages by the Hotel.


8. HOTEL EVENTS


8.1 The Hotel may host events, functions, or activities on its premises. Noise or activity disruptions may occur, and the Hotel disclaims any liability for disturbances arising from such events.


8.2 Unauthorized events or gatherings are strictly prohibited within Guest rooms or Hotel premises without prior written consent from hotel management. Violations may result in immediate eviction and forfeiture of all payments.


8.3 All common areas at Stay549 close at 10:00PM including kitchens, living room areas and outdoor areas (includes hot-tub, sauna and seasonal pool). Guests are encouraged to keep voices to a minimum to ensure all guests get a restful sleep.


8.4 To ensure the safety and security of the property Stay549 has a strict policy of "No unregistered guests permitted onsite". We understand from time to time that it would be amazing to have friends and family over to visit you at Stay549. For those occasions we have a limited number of Day passes offered from June to September for an additional charge. Some restrictions apply. Contact the front desk for additional information.


9. DISPUTE RESOLUTION


9.1 In the event of any dispute arising from or relating to these Terms or the Guest’s stay at the Hotel, the matter shall first be referred to Hotel management for resolution.


9.2 If a resolution cannot be achieved through direct negotiation, the dispute shall be submitted to binding arbitration under the rules of The Arbitration Act, C.C.S.M. c. A120 and any decision shall be final and binding.


10. CCTV MONITORING


10.1 The Hotel utilizes Closed-Circuit Television (CCTV) in common areas for security and safety purposes. By staying at the Hotel, You consent to video surveillance in these areas.


10.2 CCTV footage may be used for investigative purposes and shared with law enforcement agencies if required by law. The footage is stored securely and in accordance with applicable data protection laws.


11. MODIFICATION OF TERMS


11.1 The Hotel reserves the right to modify, update, or amend these Terms at any time without prior notice. The revised Terms will be effective upon posting on our website or at the front desk.


11.2 Your continued use of the Hotel’s services following any changes constitutes acceptance of the revised Terms.


12. USE OF PERSONAL INFORMATION


12.1 The Hotel collects and processes personal data in accordance with applicable data protection laws and our Privacy Policy. This includes, but is not limited to, information necessary for booking, identity verification, and service provision.


12.2 By providing personal information, You consent to its use for the purposes of managing Your reservation, fulfilling legal obligations, and improving our services.


13. LIMITATION OF LIABILITY AND ACCEPTANCE OF RISK


13.1 General Liability Disclaimer: The Hotel, its owners, affiliates, officers, employees, and agents (collectively, "Hotel Parties") shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or in connection with Your stay, use of Hotel facilities, or services, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if the Hotel has been advised of the possibility of such damages.


13.2 No Liability for Loss of Personal Property: The Hotel shall not be liable for the loss, theft, or damage of any personal property brought onto the premises by the Guest, including but not limited to money, jewelry, electronics, and other valuables. Guests are strongly advised to use in-room safes (if available) or deposit valuables at the front desk for safekeeping. The Hotel's liability for loss or damage to property, where required by law, shall be limited to the maximum statutory amount.


13.3 Liability for Damages to Hotel Property: The Guest shall be liable for any and all damages to Hotel property caused by the Guest, their invitees, or anyone under the Guest’s control. The Hotel reserves the right to charge the credit or debit card on file for the full cost of repairs, replacement, and any resulting loss of revenue due to the damage. This includes, but is


not limited to, damage to furnishings, fixtures, electronic devices, and structural components of the room or common areas.


13.4 Liability for Personal Injuries: The Hotel Parties shall not be liable for any injuries, accidents, or medical conditions suffered by Guests or their invitees during their stay unless such injury was caused directly by the gross negligence or intentional misconduct of the Hotel Parties. Guests acknowledge the inherent risks associated with the use of Hotel facilities, including but not limited to fitness centers, pools, recreational areas, and elevators, and assume full responsibility for their actions.


13.5 Assumption of Risk: By staying at the Hotel, Guests acknowledge and voluntarily assume all risks associated with their stay, including but not limited to risks of illness, physical injury, death, or property damage. This assumption of risk includes but is not limited to injuries arising from slips, falls, use of amenities (such as gym equipment, swimming pools, or hot tubs), food or beverage consumption, and participation in any Hotel-sponsored activities or events.


13.6 Exclusion of Liability for Indirect Damages: Under no circumstances shall the Hotel Parties be liable for any indirect, consequential, exemplary, incidental, or punitive damages, including but not limited to loss of business, loss of income, loss of goodwill, or emotional distress, even if such damages were foreseeable.


13.7 Indemnification: Guests agree to indemnify, defend, and hold harmless the Hotel Parties from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with (a) any breach of these Terms by the Guest, (b) any damage caused by the Guest or their invitees, and (c) any injury or harm suffered by the Guest or their invitees while on Hotel premises.


13.8 Force Majeure: The Hotel Parties shall not be liable for any loss, damage, or injury caused by events beyond the reasonable control of the Hotel, including but not limited to acts of God, natural disasters, fire, flood, war, civil unrest, terrorism, pandemics, government action, power failure, or any other unforeseen circumstances.


13.9 No Warranties: The Hotel makes no representations, warranties, or guarantees, express or implied, regarding the suitability, quality, safety, or fitness of the premises, services, or facilities. All services and facilities are provided "as is" and "as available."


13.10 Legal Compliance: The Guest agrees to comply with all local, state, and federal laws during their stay. The Hotel shall not be liable for any claims, losses, or liabilities arising from the Guest’s failure to comply with such laws, including but not limited to claims related to illegal activities, unauthorized gatherings, or breaches of public health regulations.


13.11 Limitation of Legal Actions: Any legal action arising from or relating to the Guest's stay or these Terms must be filed within one (1) year from the date the cause of action arose, regardless of any statute or law to the contrary. Failure to bring such action within the specified time frame shall result in a permanent waiver of the claim.


14. NO PETS POLICY


14.1 General Prohibition: The Hotel enforces a strict No Pets Policy. Guests are not permitted to bring pets or animals of any kind onto Hotel premises, including rooms, common areas, and Hotel grounds, unless specifically authorized under applicable law (e.g., service animals).


14.2 Violation of Policy: If a Guest is found to have brought a pet or non-qualifying animal onto the premises, the Hotel reserves the right to:

• Charge a cleaning fee of $500.00 to cover the cost of deep cleaning the room and removing allergens.

• Require the immediate removal of the animal from the premises.

• Cancel the Guest’s reservation without refund and request the Guest to vacate the Hotel.


14.3 No Liability for Allergic Reactions: The Hotel disclaims any liability for allergic reactions or other health issues that may arise from the presence of service animals or unauthorized pets brought onto the premises in violation of this policy.


15. THIRD PARTY RIGHTS


15.1 These Terms do not create any rights enforceable by any third party under applicable law.


16. WAIVER


16.1 No waiver by the Hotel of any provision of these Terms shall be effective unless made in writing. Failure to enforce any provision shall not be construed as a waiver.


17. SEVERANCE


17.1 If any provision of these Terms is deemed invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force.


18. DAMAGES


18.1 The Guest shall be liable for any damage caused to the Hotel property. The Hotel reserves the right to charge the Guest’s credit card for any damages incurred.


19. GOVERNING LAW AND JURISDICTION


These Terms shall be governed by and construed in accordance with the laws of Winnipeg, Manitoba, Canada. Any legal action shall be brought exclusively in the courts of Winnipeg, Manitoba, Canada.


20. POOL AND SPA RULES 


Pool Hours

May 15th to September 1st

o Monday to Thursday: 10:00 AM to 9:00 PM

o Friday to Sunday: 10:00 AM to 10:00 PM


Hot Tub Hours

• September 1st – May 31st: 6:00 PM to 9:00 PM

• June to August: 10:00 AM to 10:00 PM


General Facility Rules


19.1 No Lifeguard on Duty: Guests are advised that there is no lifeguard on duty. All swimming is undertaken at the Guest's own risk.


19.2 Non-Swimmers: Non-swimmers are required to wear lifejackets while using the pool area. The pool contains deep water and steep drop-offs, and all Guests must take appropriate precautions.


19.3 Health Code Compliance:


• Infectious Diseases: In accordance with the Manitoba Health Code, any person with an infectious disease or open sores on their body is prohibited from entering the water.

• Glass Containers: Glass containers are strictly prohibited in the pool and deck area.

• Hazardous Behavior: Engaging in behavior that may be hazardous to others in and around the pool or spa area is prohibited.


19.4 Attire Requirements:


• Bathing Suits Only: Only appropriate bathing suits are permitted in the pool and hot tub. T-shirts and shorts are not acceptable.


19.5 Safety Protocols:


• Safety must be observed at all times while in the pool or spa area.

• The pool gate must remain closed at all times to prevent unauthorized access.


19.6 Spa and Hot Tub Usage:


• Oils and Soaps: The use of oils, soaps, or any other substances in the hot tub is strictly prohibited.

• Spa Jets: Please ensure that high jets are turned off after use.

• Cover: Do not sit or lie on the cover of the spa, as this may cause damage.

• Water Safety: Guests must keep their head above water while in the spa.


19.7 Temperature Settings: Guests are not permitted to alter the temperature of the pool or spa. The temperatures are preset to ensure safety and comfort for all Guests.


19.8 Therapeutic Use Only:


• The hot tub and pool are intended for therapeutic use only.


Violation of Pool or Spa Rules

Failure to comply with these rules will result in the immediate removal of the Guest from the pool or spa area. Repeated violations may lead to further disciplinary actions, including banning from the facilities.


20. SAUNA RULES


20.1 Use of Sauna:


• The sauna is for relaxation and therapeutic use only.


• Guests must wear appropriate attire (bathing suits or sauna-specific wear) while in the sauna.


20.2 Electric Heater:


• The sauna is equipped with an electric heater. Do not pour water on the electric heater.


• Water should not be used on the heater, as it may cause damage to the equipment and create hazardous conditions.


20.3 Water on Rocks:


• Do not pour water on the sauna rocks. The sauna is designed to operate with dry heat. Adding water can interfere with the proper function of the sauna and pose safety risks.


20.4 Sauna Time Limit:


• Guests are encouraged to limit their sauna sessions to 15-20 minutes to avoid overheating.


• After each session, please allow the sauna to cool down before re-entering.


20.5 Supervision and Safety:


• No food, beverages, or glass containers are permitted inside the sauna.


• Guests should refrain from bringing electronic devices or valuables into the sauna.


• Guests must remain seated or reclined on the benches and avoid standing on the heater or rocks.


20.6 Health and Medical Conditions:


• Guests with cardiovascular conditions, skin conditions, or other medical concerns should consult a doctor before using the sauna.


• Pregnant women are advised not to use the sauna without prior consultation with their healthcare provider.


20.7 General Behavior:


• Loud conversations, disruptive behavior, and the use of strong perfumes or fragrances in the sauna are prohibited.


• Please respect the privacy and comfort of others using the sauna.


20.8 Violation of Sauna Rules:


• Any failure to adhere to these rules may result in removal from the sauna facilities.


• Repeated violations may lead to a ban from using the sauna.


22. APPLICABILITY TO ALL PARTIES ON THE RESERVATION


22.1 Binding Agreement: These Terms and Conditions apply to all parties listed on the reservation, including any additional guests, visitors, or individuals accompanying the primary guest. By making a reservation, the primary guest acknowledges and agrees that they are acting

on behalf of all individuals included in the reservation and that all parties are bound by these Terms.


22.2 Responsibility of the Primary Guest: The primary guest is responsible for ensuring that all individuals included in the reservation adhere to the rules and policies outlined in this document. The primary guest shall be liable for any breach of these Terms by any member of their party, including but not limited to the payment of fees, damages, or fines resulting from such breaches.


22.3 Enforcement of Terms: In the event that any guest or party member violates any provision of this document, the Hotel reserves the right to take appropriate action, including but not limited to removing the offending party from the premises, charging applicable fees, and pursuing legal remedies as necessary.

Cancellation Policy

Per property terms and conditions:

2.5 All bookings in June, July and August are subject to a 50% cancellation fee charged at booking. Cancellations made prior to check-in (2:00 PM local time) will be subject to the 50% deposit as a non refundable fee. No-shows will be charged the full amount of the reservation.
